A Kenton County judge has refused to issue a gag order intended to stop officials from talking about the case against a Villa Hills makeup artist accused of having sex with a teenage friend of her son.

"We're going to lose her ability to have her day in court," Charles Schaffner, one of three attorneys for Dinkel, said during a court hearing Friday. "I don't think they need to be talking to the press."

Dinkel has pleaded not guilty to charges of third-degree rape and third-degree sodomy. Villa Hills police said the allegations arose after they were called to Dinkel's home in October to investigate a report that alcohol was being supplied to minors at a loud party.

The case has received intensive media coverage because Dinkel is the wife of former Cincinnati Bengal Tom Dinkel and a minor celebrity in her own right - a Hollywood makeup artist who has worked on a number of movies, including "The Shawshank Redemption" and "Bad Boys," which starred Martin Lawrence and Will Smith.

Her attorneys held a press conference Thursday to remind people that she is innocent until proven guilty. They then filed a motion for the gag order, seeking to have anyone involved in the case prohibited from speaking about it.

Assistant Commonwealth Attorney Jim Redwine said the request would keep third parties - such as the alleged victim - from speaking out. And the youth's own attorney said he should maintain to right to free speech if he wants to talk.

The attorney, Rene Heinrich, said many people in the community already know who the boy is, and it's a poorly held secret at Covington Catholic High School, which he and Dinkel's son both attend.

Ruttle did agree to redact some information in the court file, such as the boy's name and any Social Security numbers. But she refused to go further, saying public officials know their responsibilities and have acted in good faith so far.
