The San Antonio girl, who alleged the abuse happened between 2003 and 2004 when she was 16, approached authorities a year after she left the facility in 2004. The grand jury may have questioned her timing, Brown County District Attorney Michael Murray said.

The girl told investigators that her relationship with the guard at the Ron Jackson State Juvenile Correctional Complex in Brownwood began with special treatment - extra food, drugs and phone privileges - and led to frequent sex, Mr. Murray said.

The district attorney's investigation found evidence that the guard abused four teenage girls, but Mr. Murray decided to take only the San Antonio girl's case forward. Two of the other girls failed polygraph tests.
